INFORMATION CONCERNING PRIVACY POLICY EX ART. 13 OF THE GENERAL REGULATION FOR THE PROTECTION OF PERSONAL DATA 2016/679 (GDPR)

Mottura S.p.A. with its registered office in San Giusto C.se, Via XXV Luglio 1 (hereinafter “nome società”) makes an ongoing effort to protect the online privacy of its customers.

  1. A) Personal data source and data controller

This document was drawn up under art. 13 of the EU Regulation 2016/679 (hereinafter: “Regolamento”), in order to let you know our privacy policy. General procedures for the personal data processing of the website users and of cookies as well as management of personal information when using our website www.mottura.com (hereinafter “Sito”) are provided.

Information and data provided by you or otherwise acquired when using services of Mottura S.p.A. – e.g. access to the restricted area of the website, newsletters, and so on, hereinafter “Servizi” – will be processed in accordance with the provisions of the Regulation and confidentiality requirements which are the basis for the Mottura S.p.A operations.

Under the rules  of the Regulation, the processing of personal data carried out by Mottura S.p.A. will be based on the principles of lawfulness, propriety, transparency, purpose limitation and data retention, data minimization, accuracy, integrity and confidentiality of data.

The data controller of the activities carried out through the website is Mottura S.p.A., headquartered in San Giusto C.se Via XXV Luglio 1, as defined above, to whom you can ask any information concerning the processing of personal data.

 

This information refers only for this site and it is not applied to any other websites visited by the user through a link. Further information  and any requests for consent of each data processing may be found on relevant specific sections of the website.

 

  1. B) Types of handled data

After browsing the site, please be informed that Mottura S.p.A. will handle your personal data (art. 4(1) of the Regulation), hereinafter just “Dati Personali”.

Personal data processed via website are particularly the following ones:

 

  1. Navigation data

During operations, information systems and software procedures connected  with the website acquire some personal data as part of their  standard functioning and the transmission of such data is an inherent feature of internet communication protocols. This type of information is not collected to be associated with the identified party, but by nature could make it possible to identify the users, through processing and combination of data managed by third parties. This data category includes IP addresses or domain names  used by any user connecting up to the website, the URI addresses of the requested resources (Uniform Resource Identifier), the time of such requests, the method used for submitting a given request to the server, returned file size, a numerical code relating to server response status (successfully performed, error, etc.) and other parameters related to the user’s operating system and computer environment. These data are necessary only to extract statistical information on service usage, to check functioning of the services (see infra of cookie paragraph) and to prevent any misuse of the site or any fraudulent activity and they will be immediately deleted after the processing.

Data could be used by the competent authorities to ascertain liability in the event of computer offenses committed against the site.

 

  1. Data voluntarily provided by the user

Apart from the mention in navigation data, the user is free to provide personal data contained in any request forms of the website (e.g. activation of newsletter, free registration to the website, purchasing, etc.). In the event of non-submission of personal data, could make it impossible to provide the services requested. In such cases, only information necessary to the requested service will be requested (see specific summary information in detail).

When using some site services, could happen that personal data of third parties you sent to Mottura S.p.A. are processed. In any situation where you decide to share personal data related to other persons through the website, you will be considered as an independent data controller regarding the personal data and must assume all inherent legal obligations and responsibilities. To this end, you must fully indemnify Mottura S.p.A. against any complaints, claims or demands for compensation for damages which may arise from the processing of this personal data, initiated by the third parties whose personal data have been processed through the use of the site in violation of the applicable rules on personal data protection.

In any case, if you provide or in other way process personal data of third parties using the site, you henceforth guarantee – assuming all related responsibilities – that this specific processing is grounded on an appropriate legal basis in accordance with art. 6 of the Regulation, which legitimizes the processing of the information in question.

 

  1. C) Purposes for processing of personal data and legal basis

The purposes of the processing of your personal data that we intend to carry out, following your explicit consent when necessary, are the following:

  • To provide the services requested;

Legal basis for the processing is the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract(art. 6(1)(b)) of the Regulation , since processing operations are required in order to provide the services.

The provision of personal data  for these purposes is optional, however, failure to provide them would imply the inability to initiate the services provided by the site.

 

  1. D) Recipients of personal data

For the purposes referred above, your personal data may be shared with:

  • Persons authorized by Mottura S.p.A. to process the personal data required for carrying out activities strictly related to the provision of the services, who have committed themselves to confidentially or have an appropriate legal obligation of confidentiality (e.g. employees and system administrator)
  • Any third parties responsible for managing the site, who typically act as data processors (a complete and updated list of processors is available at the address www.mottura.com.
  • parties, entities or authorities to which your Personal Data must be disclosed by law or order of an authority.

 

  1. E) Transfer of personal data

Some of your personal data will be shared with recipients who may be located outside the European Economic Area. Mottura S.p.A. will ensure that such recipients process your personal data in accordance with the GDPR, on the basis of an adequacy decision, standard contractual clauses approved by the European Commission or another appropriate legal basis.

 

  1. F) User’s right (ex art. 15 et seq. Of the Regulation)

Under articles 15 and the following of the Regulation, you, as a data subject, are entitled to request from Mottura S.p.A., at any time, access to your personal data, the correction and erasure of your personal data, as well as to object to its processing. You are also entitled to request the restriction of the processing of your personal data in the cases set out in art. 18 of the Regulation, as well as to obtain the personal data you have provided in a structured, commonly used and machine-readable format, in the cases set out in art. 20 of the Regulation.

Requestes should be made in writing to privacy@mottura.com.

In any case, you will always be entitled to file a complaint with the competent supervisory authority (the Italian Data Protection Authority), pursuant to art. 77 of the Regulation, if you believe that the processing of your data violates applicable law.

 

  1. G) Amendments

The above privacy policy is effective since May 25th, 2018. Mottura S.p.A. reserves the right to partly or fully amend this Privacy Policy, or simply to update its content, as a result of changes in applicable law. Mottura S.p.A. will inform you of such changes as soon as they are introduced, and they will be binding as soon as they are published on the site.

Mottura S.p.A. therefore invites you to regularly visit this Privacy Policy in order to acquaint yourself with the latest, updated version of the Privacy Policy, so that you may remain constantly informed on how Diennea collects and uses Personal Data.
